Keep Rising Unlimited LLC, doing business as Keep Rising (“Keep Rising,” “we,” “us,” or “our”), provides software that helps advisors, coaches, therapists, case managers, and similar professionals stay connected with the people they serve between sessions.
This Privacy Policy explains what information we collect, how we use it, and the choices you have. It applies to our website at keeprising.io, our web and mobile applications, and the Keep Rising Lite text-messaging service (together, the “Services”).
This policy uses three words throughout: a Practice is the organization or professional that subscribes to the Services; an Advisor is an individual authorized by a Practice to work with clients; and a Client is an individual who receives messages and resources because an Advisor enrolled them.
1. Information We Collect
Contact and account information. Your name, email address, phone number, mailing address, job title, and the credentials you use to sign in.
Mobile number and messaging consent. If you are a Client, we collect the mobile number you provide during enrollment with your Advisor, along with a record of your consent — the date and time, the Advisor who enrolled you, and the exact disclosure text shown to you.
Client information entered by Practices and Advisors. Advisors enter information about the Clients they work with, including plan content, check-in responses, and messages exchanged through the Services. This information belongs to the Practice; we process it on the Practice’s behalf.
Message content. The text of messages sent and received through the Services, and engagement data such as whether a prompt was answered and whether a resource link was opened.
Billing information. For Practices, the billing contact and payment details necessary to process a subscription. Payments are handled by our payment processor; we do not store full payment-card numbers on our systems.
Device and usage information. Your IP address, browser type, operating system, the pages you visit, and the features you use.
Cookies and similar technologies. We use cookies and similar technologies to keep you signed in, remember your preferences, and understand how the Services are used. You can control cookies through your browser settings; some features may not work if you disable them.
2. How We Use Information
We use the information we collect to:
- provide, operate, secure, and improve the Services;
- deliver the messages a Client has consented to receive and route replies to the right Advisor;
- authenticate users and maintain account security;
- maintain the audit and recordkeeping obligations that apply to us and to the Practices we serve;
- bill Practices and manage subscriptions;
- respond to questions and provide support;
- send Practices and Advisors service-related communications, and — where permitted — communications about our products, which you can opt out of at any time; and
- comply with applicable law and respond to lawful requests.
3. How We Do Not Use Information
We do not sell personal information, and we do not share personal information for cross-context behavioral advertising.
We do not use Client message content or health-related information to train generally available artificial-intelligence models.
We do not use mobile opt-in data for any purpose other than delivering the program the Client consented to receive.
4. Information Sharing and Disclosure
We share personal information only as described here.
4.1 Service providers. We engage trusted third parties who help us deliver the Services — cloud hosting, messaging and telecommunications providers, payment processing, and customer support tooling. These providers are contractually bound to handle personal information securely and are prohibited from using it for any other purpose.
Mobile opt-in data and consent are excluded from all sharing described in this section. Mobile opt-in data and consent will not be shared with or sold to third parties or affiliates for marketing purposes. Mobile information is shared only with the messaging providers strictly necessary to transmit a Client’s messages.
4.2 Practices and Advisors. Information a Client provides through the Services is available to the Practice that enrolled them and to the Advisors authorized by that Practice. Advisors see only the Clients assigned to them.
4.3 Business transfers. If Keep Rising is involved in a merger, acquisition, or sale of all or part of its assets, personal information may be transferred as part of that transaction. We will notify affected users and the receiving party will remain bound by this policy or one materially as protective.
4.4 Legal requirements. We may disclose information where we reasonably believe it is required to comply with law or a valid legal process, to enforce our agreements, or to protect the rights, safety, or property of Keep Rising, our users, or the public.
5. Health Information and HIPAA
Where a Practice is a covered entity or business associate under the Health Insurance Portability and Accountability Act (“HIPAA”) and uses the Services to create, receive, maintain, or transmit protected health information, Keep Rising acts as a business associate. In that case, a signed Business Associate Agreement between Keep Rising and the Practice governs how that information is handled, and its terms control over any conflicting term in this policy.
The Practice, not Keep Rising, decides what information is entered into the Services and what is sent to a Client. Keep Rising does not provide medical, psychiatric, or psychological advice and does not diagnose or treat any condition.
6. Data Retention
We retain personal information for as long as necessary to provide the Services and to meet the legal, audit, and recordkeeping obligations that apply to us. Records relating to protected health information, including message and consent logs, are retained for a minimum of six years, consistent with HIPAA recordkeeping standards.
When information is no longer needed, we delete it or de-identify it so that it can no longer reasonably be used to identify an individual.
7. Data Security
We use industry-standard administrative, technical, and physical safeguards to protect personal information, including encryption in transit, multi-factor authentication and automatic session timeout for Advisor accounts, role-based access so Advisors see only their assigned Clients, and audit logging.
No method of transmission or storage is completely secure. In particular, SMS is not encrypted once a message reaches a recipient’s device, and messages may be visible to anyone with access to that phone. Please keep this in mind when deciding what to share by text.
8. Your Rights and Choices
Access and correction. You may access, correct, or update your information through your account settings, or by contacting us at contact@keeprising.io. If you are a Client, requests about the information your Practice holds are handled through that Practice; we will assist them in responding.
Marketing communications. You may opt out of marketing email at any time using the unsubscribe link or by contacting us. Service-related messages necessary to operate your account will continue.
Text messages. Reply STOP to any message to stop all messages. See Section 10.
Cookies. You can control cookies through your browser settings.
Deletion. You may request deletion of your personal information. We will honor the request except where we are required to retain information by law or by the recordkeeping obligations described in Section 6.
9. State Privacy Rights
Depending on where you live, you may have additional rights — to know what personal information we hold, to request a copy of it, to request correction or deletion, and to be free from discrimination for exercising those rights. As stated in Section 3, we do not sell personal information and we do not share it for cross-context behavioral advertising.
To exercise any of these rights, contact us at contact@keeprising.io. We will verify your request before acting on it and will respond within the timeframe the applicable law requires.
10. Text Messaging (SMS)
Keep Rising operates an SMS program through which Advisors send enrolled Clients daily positive-action check-ins, appointment reminders, periodic self-rating check-ins, and replies to Client questions.
How we collect your number. We collect your mobile number only when you provide it during enrollment with your Advisor, or when you text our program directly. We do not purchase, rent, or import phone numbers from any third party.
Consent. Enrollment requires your express written consent, given by checking an unchecked consent box and entering your own mobile number. Consent is never a condition of receiving services from your Advisor or from Keep Rising, and you may decline and still use every other part of the program.
How we use your number. Your mobile number is used solely to deliver the Keep Rising messages you consented to receive, to route your replies to your Advisor, and to maintain the audit records required of us.
Mobile opt-in data and consent will not be shared with or sold to third parties or affiliates for marketing purposes. Mobile information is shared only with the messaging providers and subprocessors strictly necessary to transmit your messages, and those providers are contractually prohibited from using it for any other purpose. This restriction applies regardless of any other sharing described elsewhere in this policy.
Frequency and cost. You will receive up to four messages per day: normally one daily positive-action prompt, plus appointment reminders, periodic self-rating check-ins, and replies from your Advisor to messages you send. Message and data rates may apply.
Opting out and getting help. Reply STOP to any message to stop all messages. Reply HELP for help, or contact contact@keeprising.io or 203-217-2182. Full program terms are in our SMS Terms & Conditions.
Security note. SMS is not encrypted once delivered to your device, and messages may be visible to anyone with access to your phone.
11. Children’s Privacy
You must be at least 18 years old to hold a Keep Rising account. A Practice may enroll a Client only if that Client is at least 18, or if the Practice has obtained verifiable consent from the Client’s parent or legal guardian.
The Services are not directed to children under 13, and we do not knowingly collect personal information from them. If we learn that we have collected information from a child under 13 without the required consent, we will delete it promptly. If you believe this has happened, contact us at contact@keeprising.io.
12. Changes to this Privacy Policy
We may update this policy. For material changes we will give notice by email to account holders, by notice in the Services, or by posting the updated policy with a new “Last updated” date. The current version is always posted at this address.
